Purchase Policy
This Purchase Policy establishes rules and guidelines for all ACES events. For the purposes of this Purchase Policy, all references to “ACES” herein means ACES Basketball, LLC.
PLEASE READ THE FOLLOWING TERMS CAREFULLY AS THEY GOVERN YOUR RIGHTS UNDER THE TICKET AND CONTAIN A BINDING, INDIVIDUAL WAIVER PROVISION BY WHICH YOU GIVE UP THE RIGHT TO FILE A LAWSUIT IN COURT WITH RESPECT TO ANY DISPUTES RELATING TO THE TICKET OR THE EVENT FOR WHICH THE TICKET IS ISSUED.
THIS TICKET IS A REVOCABLE LICENSE. ANY PERSON PURCHASING AND/OR USING THIS TICKET (“TICKET HOLDER”) ACKNOWLEDGES AND AGREES THAT THE USE OF THIS TICKET FOR ADMISSION TO ANY ACES EVENT IS CONDITIONED UPON TICKET HOLDERS’ AGREEMENT TO AND COMPLIANCE WITH THE TERMS OF THIS PURCHASE POLICY AS SET FORTH HEREIN. ANY GUESTS, COMPANIONS, OR OTHER PERSONS, INCLUDING MINORS, WHO RECEIVE AND/USE A TICKET (EVEN IF THIS INDIVIDUAL DID NOT DIRECTLY PURCHASE SAID TICKET FROM ACES) IS CONSIDERED TO BE A TICKET HOLDER FOR PURPOSES OF THIS POLICY, AND ARE EXPECTED TO ABIDE BY THE TERMS OF THIS POLICY. ACES RESERVES THE RIGHT TO REFUSE ADMISSION TO, OR EJECT, ANY PERSON FOR FAILURE TO COMPLY WITH THIS POLICY, WITHOUT REFUND.
ALL TICKET SALES ARE FINAL. NO REFUNDS, CREDITS OR EXCHANGES WILL BE OFFERED.
THE SOLE AND EXCLUSIVE REMEDY (IF ANY) if admission is refused or revoked, or the Event is cancelled and not RESCHEDULED, is a refund FROM THE ORIGINAL POINT OF SALE of up to the ticket’s face value set by ACES (“Face Value”). In all cases, refunds are only provided at ACES sole and absolute discretion.
I. Who You Are Buying From
ACES (Athletes Changing their Environment Successfully) is a leader in youth basketball events. ACES organizes tournaments and events designed to showcase the next generation of young talent, and provide them with a premier platform for athlete exposure.
II. Compliance With Event Policies
TICKET HOLDER MUST ABIDE BY THIS PURCHASE POLICY IN ADDITION TO ANY VENUE RULES, PROTOCOLS, OR PROCEDURES (COLLECTIVELY, “EVENT POLICIES”). ACES RESERVES THE RIGHT TO REFUSE ADMISSION OR TO EJECT ANY PERSON THAT FAILS TO ABIDE BY THE EVENT POLICIES, WHICH MAY BE MODIFIED, WITHOUT NOTICE.

Event Safety
BE ADVISED THAT DESPITE SPECTATOR SHIELDING MEASURES, BASKETBALLS AND OTHER OBJECTS MAY FLY INTO THE SPECTATOR AREA. STAY ALERT AT ALL TIMES, BEFORE, DURING, AND AFTER PLAY OR PERFORMANCE. IN CASE OF INJURY, IMMEDIATELY LOCATE EVENT STAFF AND ASK FOR DIRECTIONS TO ON-SITE MEDICAL.
FURTHER, SPECTATORS ARE STRICTLY PROHIBITED FROM ENTERING THE PLAYING SURFACE AND AREA AT ANY TIME DURING AN EVENT. SPECTATORS THAT VIOLATE THIS RULE ARE SUBJECT TO EJECTION AND MAY BE SUBJECT TO FURTHER PENALTIES (INCLUDING BUT NOT LIMITED TO CIVIL AND/OR CRIMINAL PROSECUTION).
You voluntarily assume all risks and danger incidental to the event for which the ticket is issued, whether occurring before, during or after the event, and you waive any claims for any and all types of personal injury or death against ACES and all of our respective affiliated entities, agents, officers, directors, owners, staff, and employees on behalf of yourself and any accompanying minor. You bear all risks of inclement weather. Event date and time are subject to change.

Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL ACES BASKETBALL, OR ITS EMPLOYEES, DIRECTORS, OFFICERS, OR AGENTS BE LIABLE FOR ANY DIRECT OR INDIRECT HARMS TO EVENT ATTENDEES CAUSED BY THEIR OWN NEGLIGENT OR INTENTIONAL, WILFUL OR WANTON MISCONDUCT. “EVENT ATTENDEES” REFERS TO (I) THE PURCHASER OF A TICKET TO ANY ACES EVENT; AND (II) ALL TICKET/WRISTBAND HOLDERS THAT ATTEND A ACES EVENT, REGARDLESS OF WHETHER THIS INDIVIDUAL PURCHASED THE TICKET. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND (GENERAL, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, LOSS OF INCOME OR PROFITS), WHETHER IN CONTRACT OR TORT. FOR THE AVOIDANCE OF ALL DOUBT, THIS INCLUDES, BUT IS NOT LIMITED TO, HARM RESULTING FROM FAILURE TO ADHERE TO WARNINGS FROM ACES OR EVENT VENUE PERSONNEL; FAILURE TO COMPLY WITH ANY POSTED RULES AND REGULATIONS OF THE EVENT VENUE; ENGAGING IN DISRUPTIVE OR DISORDERLY CONDUCT THAT INTERFERES WITH THE EVENT OR OTHER ATTENDEES; UNAUTHORIZED ENTRY INTO RESTRICTED AREAS OF THE EVENT VENUE; USE OF PROHIBITED SUBSTANCES AT AN EVENT; PHYSICAL ALTERCATIONS WITH OR THREATS OF PHYSICAL VIOLENCE BY THIRD PARTIES; LEAVING PERSONAL BELONGINGS UNATTENDED; FAILURE TO SUPERVISE MINORS UNDER THEIR CARE; RUNNING ONTO THE COURT OR PLAYING SURFACE DURING ACTIVE PLAY; OR INTERFERING WITH EVENT STAFF OR OFFICIALS. THE FOREGOING IS NOT INTENDED TO BE AN EXHAUSTIVE OR EXCLUSIVE LIST OF POTENTIAL CAUSES OF HARM.

YOU ARE SUBJECT TO SEARCH
All Event Attendees, including their personal belongings, may be subject to a search upon entry to ACES Events. If you choose not to consent to a search, you may be denied entry to the event, without refund or other compensation. Prohibited items include, without limitation: firearms (including ammunition); explosives; other weapons (e.g., knives, boxcutters, pepper spray); alcohol; tobacco; vaping devices; controlled substances; laser pointers; fireworks; irritants (e.g., artificial noisemakers). The list of prohibited items is subject to change based on the specific policies of the Event Venue.

Name, Image and Likeness and Other Rights of Publicity
All Event Attendees agree that all ACES Events are public events, and that your presence inside and outside the venue where the event occurs are public in nature, and therefore you have no reasonable expectation of privacy with regard to your actions or conduct at the event. You (and all Event Attendees), in exchange for attending the event(s), expressly grant permission to ACES, and its affiliates, representatives, agents, licensors, licensees, assigns, partners and vendors, including its brand and/or media partners, to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event, for any purpose (including but not limited to: commercial and/or promotional), in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to you.

UNAUTHORIZED COMMERCIAL USE OF TICKET / UNAUTHORIZED TRANSMISSION
TICKETS TO ACES EVENTS MAY NOT BE USED FOR ADVERTISING, PROMOTIONAL (INCLUDING CONTESTS AND SWEEPSTAKES) , OR OTHER COMMERCIAL PURPOSES WITHOUT PRIOR WRITTEN CONSENT FROM ACES, WHICH ACES MAY GRANT OR WITHHOLD AT ITS SOLE AND ABSOLUTE DISCRETION.
CODE OF CONDUCT

In order for ACES and its participants to win together, and to foster a safe, fun, welcoming environment for all involved, participants in ACES events must abide by ACES rules. Participation in a ACES event is a privilege, not a right.
All ACES attendees/participants (and legal guardians, if the participant is under 18) are responsible for reading, understanding, and adhering to this Code of Conduct (the “Code of Conduct”). This Code of Conduct applies to all attendees/participants present at ACES events, including but not limited to athletes and their guardians, coaches, trainers and other miscellaneous team personnel, staff, and advisors, spectators, and anyone else that participates in or attends a ACES event (individually referred to herein as an “Attendee” or “Participant” and collectively referred to herein as “Attendees” or “Participants”).
Any violation of this Code of Conduct may result in a loss of playing time, team forfeiture, individual and/or team expulsion from the event/circuit, individual and/or team suspension from the event/circuit and/or future events/circuits, and or banishment (whether temporary or permanent depending on the nature and severity of the act) without any form of refund.
I. Commitment to Sport
ACES is committed to creating and maintaining a sport community where all those who participate can work and learn together in an atmosphere free from all forms of emotional, mental, physical, and sexual misconduct. This Code of Conduct discusses prohibited misconduct, response, and resolution. In addition to the policies in this Code of Conduct, ACES has adopted and incorporated some definitions and portions of the SafeSport Code for the U.S. Olympic and Paralympic Movement (the “Code”) and its appendices (collectively, the “Code”), as it may be amended from time to time, by the U.S. Center for SafeSport (“SafeSport”) into this Code of Conduct (only explicitly as stated by the Code of Conduct).
All individuals participating in and/or attending any ACES event are within ACES jurisdiction and disciplinary authority. All Attendees are responsible for their own actions and for knowing the information, policies, and procedures outlined in this Code of Conduct, and any other related policies, regulations, and rules. Attendees may also be subject to the rules, policies, and procedures of SafeSport, and if applicable, shall submit, without reservation or condition, to the jurisdiction of SafeSport for the resolution of any alleged violation of SafeSport’s rules, policies and procedures, or SafeSport’s Code. Ignorance of any rule or regulation in this Code of Conduct or otherwise, is not a defense to a violation or alleged violation of this Code of Conduct, or any ACES rule, regulation, policy, or procedure. For the avoidance of doubt, a violation SafeSport’s Code, rules, policies, and procedures, may also be considered a violation of this Code of Conduct. ACES, at its sole discretion, may agree to mirror and enforce any sanction, punishment, or measures imposed by SafeSport, whether interim, temporary, or permanent, although ACES does not operate under SafeSport’s purview and is not obligated to follow SafeSport’s decision.
For the avoidance of doubt, ACES operates completely independently from SafeSport, and as such, ACES makes its own decisions regarding the creation, implementation, and adherence to ACES rules, policies, and procedures at its sole and ultimate discretion. Any disagreement with any ACES rule, policy, procedure, or otherwise, shall be submitted to ACES for ACES to be the ultimate arbiter of the outcome. By attending a ACES event, you agree that you will abide by ACES decision regarding disciplinary action and waive any and all rights to challenge ACES decision in any manner whatsoever.
ACES may make changes to the Code of Conduct, and other related rules, policies, and procedures, from time to time. Once posted online, changes are effective immediately unless otherwise noted. Through education, resources, training, and adherence to the rules, policies, and procedures contained in SafeSport’s Code (where referenced) and this Code of Conduct, we will help those who participate in ACES events prevent, recognize, reduce, and respond to misconduct in basketball and in sport. II. Misconduct and Prohibited Conduct
This section of the Code of Conduct explains prohibited conduct related to emotional, physical, and sexual misconduct, including but not limited to hazing, stalking, bullying, and harassment. The privilege of being present at a ACES event may be limited, conditioned, suspended, terminated, or denied, if ACES determines an Attendees conduct is and/or was inconsistent with this Code of Conduct or in the best interest of sport and/or ACES (at ACES sole and ultimate discretion).
It is a violation of the Code of Conduct for Attendees to engage in or tolerate misconduct or Prohibited Conduct (as defined below), as well as any conduct that would violate community standards, or any conduct that would violate applicable criminal or civil laws.
ACES expressly prohibits the following types of misconduct by its Attendees:

(“Prohibited Conduct”).

ACES has a zero-tolerance policy for any form of Prohibited Conduct. Reports of Prohibited Conduct can be made in accordance with the policies and procedures detailed in Section 3 of this Code of Conduct.
The following forms of misconduct by Attendees are also expressly prohibited and subject to discipline:
· Violation of any anti-doping policies, protocols or procedures as defined by the International Olympic Committee (IOC; www.olympic.org), World Anti-Doping Agency (WADA; www.wada-ama.org), US Anti-Doping Agency (USADA; www.usada.org) or the United States Olympic Committee (USOC; www.teamusa.org).
· Violation of SafeSport rules, policies and procedures promulgated by the U.S. Center for SafeSport (www.safesport.org), including the SafeSport Code and/or Minor Athlete Abuse Prevention Policies (“MAAPP”), as they may be amended from time to time.
Discrimination against any Attendee on the basis of age, gender, race, ethnicity, culture, religion, sexual orientation, gender expression, gender identity, genetics, mental or physical disability, or any other status protected by federal, state or local law, where applicable, is prohibited
· Possession, consumption, sale or distribution of alcohol, tobacco, vaping devices or e- cigarettes, marijuana, illegal drugs, or controlled substances, if such possession, consumption, or distribution is illegal or in violation of ACES or venue policy. The possession, consumption, sale or distribution of alcohol, tobacco, vaping devices or e-cigarettes by anyone registered as an event participant or participates in an event as designated team personnel.
· The false and/or misleading use of another’s identification card.
· Physical damage to a facility, vandalism, or theft of items.
· Possession of fireworks, ammunition, knives, swords, boxcutters, firearms, or other weapons or any item or material which by commonly accepted practices and principles would be a hazard or harmful to other persons at ACES events.
· Any action considered to be an offense under Federal, State or local law ordinances.
· Violation of the specific policies, regulations, and/or procedures of ACES or the facility used in conjunction with a ACES event.
(It is the responsibility of the individual to be familiar with applicable specific policies, regulations and procedures.)
· Conduct which is inappropriate as determined by comparison to normally accepted behavior.
· Physical or verbal threats or intimidation of any type.
· Any act of fraud, deception or dishonesty in connection with any ACES related activity.
· Actions that could be detrimental to ACES reputation or bring disrepute to ACES brand.
· Any non-consensual physical contact, obscene language or gesture, or other threatening language or conduct directed towards personnel associated with a ACES event including but not limited to event staff, match officials, arbitrators, ticketing personnel, volunteers, advisors, sponsors, partners, independent contractors, venue personnel etc
· Behavior and policies that threaten an athlete’s amateur status, school and/or collegiate eligibility.
· Behavior that violates transfer policies.
· Behavior that violates recruiting policies.

Reporting A Violation of the Code of Conduct
All ACES event Attendees should familiarize themselves with these terms. ACES strongly encourages its Participants programs to adopt similar policies, which are intended to provide and promote a safe environment, free from misconduct and abuse. Should anyone participating in the activities or affairs of ACES observe behavior which violates one or more of the policies contained in this Code of Conduct or SafeSport Code, including but not limited to Prohibited Conduct, such person is responsible to immediately report their observations to a ACES representative and, where required, law enforcement authorities, and/or SafeSport. Reporting parties should not attempt to evaluate the credibility or validity of allegations before reporting to ACES, law enforcement, and/or SafeSport.

To report a concern involving misconduct or Prohibited Conduct to ACES, an individual may submit an email to acesbasketball.official@gmail.com. An anonymous report does not mean that any of the underlying information submitted will be protected and may limit ACES ability to investigate and respond to a report. For this reason, ACES encourages reports to include the reporting individual’s name and contact information.

The U.S. Center for SafeSport (the “Center”) accepts all reports of sexual abuse and child abuse within the U.S. Olympic and Paralympic Movement. The Center also accepts reports of emotional and physical misconduct (including but not limited to bullying, hazing, stalking, and harassment) within the U.S. Olympic and Paralympic Movement. Reports of emotional and physical misconduct can also be reported directly to USA Basketball, above. Individuals may also submit a report to the U.S. Center for SafeSport here:

The Center is available 24 hours a day, with an operator and Monday through Friday from 9 a.m.-5 p.m. (MT). If an individual suspects child abuse or neglect, they should report it to their local authorities before notifying USA Basketball and/or the U.S. Center for SafeSport. If an individual is a mandatory reporter, they are required by law to do so. Additional information on when a person must make a report to law enforcement can be found at www.childwelfare.gov.

To Law Enforcement
All cases of suspected emotional, physical, or sexual abuse of a minor (under the age of 18) and violations of applicable law must be reported to local law enforcement immediately. Filing a report with ACES, SafeSport or any non-law enforcing body does not satisfy this obligation.
